If a job applicant deletes their profile, their data is removed or de-identified in our applicant database but may persist in prior applications to Customers until Customer disposal. We may revise this Policy to reflect changes in our online information practices or legal compliance by posting a new version on our website. D/B/A NEOGOV, including subsidiaries PowerDMS, Inc., Cuehit, Inc., Ragnasoft LLC (D/B/A/ PlanIT Schedule), and Design PD, LLC (D/B/A Agency360) (“NEOGOV”, “Company,” “we”, “our”, or “us”), offers web-based software-as-a-service applications (SaaS Applications) and maintains websites including www.neogov.com, www.neoed.com, www.powerdms.com, www.governmentjobs.com and www.schooljobs.com (Websites, and with SaaS Applications, Services).

By using the Services, you agree to these Terms of Use and our Privacy Policy (https://www.governmentjobs.com/careers/northcarolina/privacypolicy), whether you are a registered user, job seeker, or employer (“you” or “your”). If you disagree, do not use the Services. You waive rights requiring non-electronic signatures or records for contract legality, where legally permitted.

For paid subscriptions, Service features are defined by the Customer Contract between NEOGOV and your organization (Customer). Customer Contract terms prevail in case of conflict with these Terms of Use.

Using SaaS Applications for a Customer means you agree to these Terms of Use and Privacy Policy and are responsible for actions via your account, including third-party service use and data disclosure. If added to a SaaS Application, the administrator (not you) controls your use, including access, permissions, and third-party integrations. Content you submit may be managed by the administrator. Your account may be managed by the entity owning your account email domain.

Read these Terms of Use carefully before using the Services.

We may revise these Terms of Use at our discretion, effective immediately upon posting. Continued Service use after changes means you accept them. Check this page regularly for updates, as they are binding.

  1. Eligibility. Services are for users 18+ years old capable of binding contracts. By using Services, you warrant you meet this age requirement. We are based in California, USA. Services are accessible globally but may be illegal in certain countries or for certain individuals. Access from outside the US is at your own initiative, with responsibility for local law compliance. Access from illegal territories is prohibited. You are responsible for US and applicable export/related statute and regulation compliance.

  2. Accessing Services and Account Security. We grant a non-exclusive, limited, revocable, personal, non-transferable license to use Services, contingent on your compliance with these Terms of Use. Unless a Customer Contract allows Service use on a Customer’s behalf, use is limited to your own transactions. If using Services for a Customer, you warrant authorization to do so. Service access may require registration details or other information, which must be correct, current, and complete. All provided information is governed by the Privacy Policy, and you consent to actions consistent with it. Undefined terms inherit meanings from the Privacy Policy.

    If you choose or receive login credentials (username, password, etc.), treat them as confidential and do not share them. Your account is personal, and you must not grant access to others.

    Between you and others (including Customers), your account is yours. However, if a Customer purchased Services for your use, they can control access and receive usage reports.

    Notify us immediately of unauthorized access or security breaches, assist in maintaining confidentiality, and help enforce our rights and comply with security breach notification laws. Use caution when accessing your account on public/shared computers. We may disable any login credentials if you violate these Terms of Use.

  3. Term and Termination. Paid subscriptions (e.g., employer purchases) are annual and auto-renew annually unless either party gives 30-day non-renewal notice before term end (email sufficient). User/job seeker accounts can be terminated anytime. NEOGOV permission to use Services terminates automatically upon your Terms of Use violation. NEOGOV may terminate or suspend your account or Service access anytime for any reason, with or without notice, and may alter, suspend, or discontinue Services or any part thereof without notice. NEOGOV is not liable for Service changes or access suspension/termination.

    Our rights to use and disclose your feedback survive termination.

  4. Intellectual Property Rights. Services and NEOGOV Content (information, software, specifications, text, displays, images, video, audio, code, design, trademarks, etc.) are owned by NEOGOV and protected by US and international copyright, trademark, patent, trade secret, and other intellectual property laws. These Terms of Use allow Service use for personal, non-commercial use, or Customer internal business use, under specified license rights. No other licenses to NEOGOV Content are granted, except:

    ● Temporary RAM storage for accessing and viewing materials.

    ● Cached files by your web browser for display enhancement.

    ● Download of single copies of desktop, mobile, or other applications for personal, non-commercial use, subject to end-user license agreements.

    No Service or content rights are transferred to you; all ungranted rights are reserved by us. Unauthorized Service use breaches these Terms of Use and may violate copyright, trademark, and other laws.

  5. Trademarks. “NEOGOV,” “NEOED”, “Governmentjobs.com,” “Schooljobs.com,” “PowerDMS,” and certain other names/logos are our trademarks, as are related product/service names, design marks, and slogans (excluding partner marks). Use of our marks without written permission is prohibited. We retain rights in designated color schemes and column names within Services. Service “look and feel” (color combinations, button shapes, layout, design, etc.) are also our trademarks or copyrights.

  6. Prohibited Uses. Use Services lawfully and according to these Terms of Use. You must not:

    1. Submit or post malware (viruses, worms, etc.).
    2. Create false identities, misrepresent identity, create profiles for others, post false/inaccurate resume info, or use another’s account.
    3. Disclose unauthorized information (e.g., Customer confidential info).
    4. Reproduce, distribute, modify, create derivatives of, publicly display/perform, republish, download, store, license, transfer, sell, transmit, or copy NEOGOV Content or Services, or sublicense Services.
    5. Remove or alter legal notices, copyright/trademark, or proprietary rights notices from Service materials.
    6. Reverse engineer, decompile, disassemble, or attempt to access Service source code or algorithms.
    7. Commercially use Services or materials (except for Customer internal business use).
    8. Use Services/NEOGOV Content in ways that cause confusion, disparage NEOGOV, interfere with Service operation or transactions, or disrupt others’ Service use.
    9. Violate NEOGOV or others’ intellectual property rights, including unauthorized copying/distribution of others’ content.

    You further agree not to use Services:

    1. Violating any applicable law or regulation (including export laws).
    2. Exploiting or harming minors.
    3. Unlawfully using others’ personally identifiable information.
    4. Transmitting unauthorized advertising/promotional material (spam, junk mail, etc.).
    5. Sending unsolicited communications to users, or contacting users who opted out of contact.
    6. Responding to job opportunities for reasons other than job application.
    7. Engaging in conduct that restricts/inhibits Service use, harms NEOGOV or users, or exposes them to liability.
    8. Using automated tools (page-scrape, robots, spiders, etc.) to access, copy, or monitor Services/NEOGOV Content or obtain materials not intentionally made available.
    9. Attempting unauthorized Service access, or access to related systems/networks or NEOGOV servers, via hacking or illegitimate means.
    10. Scanning or testing Service/network vulnerability, or breaching security/authentication measures.
    11. Taking actions imposing unreasonable load on Service/NEOGOV infrastructure or networks, or interfering with Service operation.
    12. Attacking Services via denial-of-service or distributed denial-of-service attacks.
    13. Accessing Services to build competitive products, copy Service features/graphics, or facilitate competitive product assembly.

    If your Service use requires industry-specific regulation compliance, you are solely responsible. Do not use Services to subject NEOGOV to such regulations without prior written agreement (e.g., handling “protected health information”).

    Limit your access level to necessary tasks. Notify NEOGOV immediately if you believe you have excessive access.

  7. Monitoring and Enforcement; Termination. We may monitor Services to (1) comply with laws, regulations, or government requests, (2) operate Services and protect our/user interests, and (3) for other necessary or appropriate purposes. Specifically, we may:

    1. Remove/refuse to post User Contributions for any reason at our discretion.
    2. Take action on User Contributions deemed necessary or appropriate, including for Terms of Use violations, liability risk, brand damage, user loss, ISP/supplier interference, or if abusive, disruptive, offensive, illegal, rights-violating, harmful, or infringing.
    3. Disclose your identity to third parties claiming your posted material violates their rights (IP, privacy).
    4. Take legal action for illegal/unauthorized Service use.
    5. Terminate/suspend Service access for any or no reason, including Terms of Use violations. We may cooperate with law enforcement/court orders to disclose user identities. YOU WAIVE AND HOLD HARMLESS GOVERNMENTJOBS.COM, INC. AND AFFILIATES FROM CLAIMS ARISING FROM ACTIONS TAKEN DURING OR AS A CONSEQUENCE OF INVESTIGATIONS BY GOVERNMENTJOBS.COM, INC. OR LAW ENFORCEMENT.

    We are not responsible for screening, policing, editing, or monitoring postings and encourage user discretion. We assume no liability for action/inaction regarding user/third-party content. We are not liable to anyone for activities described in this section.

  8. Content Standards. These Content Standards apply to all User Contributions and Service use. User Contributions must comply with all applicable laws and regulations and must not:

    1. Be defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable.
    2. Promote sexually explicit/pornographic material, violence, or discrimination based on protected characteristics.
    3. Infringe intellectual property or other rights.
    4. Violate legal rights (privacy, publicity) or create civil/criminal liability, or conflict with Terms of Use/Privacy Policy.
    5. Be deceptive.
    6. Promote illegal activity or unlawful acts.
    7. Cause annoyance, inconvenience, anxiety, embarrassment, alarm, or annoyance.
    8. Impersonate others or misrepresent identity/affiliation.
    9. Involve commercial activities/sales (contests, sweepstakes, advertising).
    10. Imply endorsement by us or others if untrue.

    You are solely responsible for the legality, accuracy, and completeness of all records, data, and information you provide in connection with these Terms of Use or Service use.

  9. User Contributions. Services may include Interactive Services (message boards, forums, job boards) allowing users to post materials/content (User Contributions). User Contributions must comply with Content Standards. Posts are non-confidential and non-proprietary. You represent you have necessary posting rights and acknowledge we have no control over idea/information use after posting. By posting User Contributions, you grant us and affiliates a royalty-free, perpetual, irrevocable, transferable, non-exclusive right/license to use, reproduce, distribute, modify, display, etc., worldwide, without approval or consideration, in any media, for the term of content rights, and waive related claims. Despite this license, we are not publishers of User Contributions and act only as intermediaries enabling posting. We are not responsible for posting deletion/storage failure and recommend against posting confidential/sensitive information.

    We are not obligated to edit/control User Contributions and are not responsible for them. You may encounter inaccurate, offensive, or objectionable User Contributions. You waive legal/equitable rights against NEOGOV regarding User Contributions. NEOGOV disclaims liability for User Contributions. Upon notification of non-compliant User Contributions, NEOGOV may investigate and decide at its discretion to remove them, reserving the right to do so anytime without notice.

    You are responsible for your User Contributions, including legality, reliability, accuracy, and appropriateness. We are not liable to third parties for your or others’ User Contribution content/accuracy.

  10. Text Message and Email Communications. We may offer text message and email notifications for notices, reminders, updates, support, admin messages, and HR-related notices from us or Customers, routed via third-party services.

    SMS messages are sent per your preferences, only after opt-in. Opt-out by replying “OPTOUT” (all caps); opt-in again with “OPTIN”.

    Job seekers can manage SMS receipt via account preferences, by contacting the Customer in question, or NEOGOV Support at [email protected].

    By allowing SMS messages from NEOGOV/Customers, you agree to receive texts on your mobile phone, including automated messages. You certify you own/are authorized to use the mobile phone for SMS receipt.

    You are responsible for mobile carrier data/text charges from Service use, including notifications. Message frequency varies. You may receive a subscription confirmation text. NEOGOV may suspend/terminate SMS messages for any reason, with or without notice.

    SMS service depends on third-party provider functionality, which may cause delays. NEOGOV aims for timely alerts with accurate info but cannot guarantee delivery, timeliness, or accuracy. NEOGOV is not liable for alert delays, failures, misdirection, content errors, or actions taken/not taken based on alerts. Notify the Customer if your mobile number changes. NEOGOV DISCLAIMS ALL WARRANTIES REGARDING TELECOMMUNICATION SERVICES, INCLUDING AVAILABILITY, SECURITY INTRUSIONS, AND DISCLOSURE OF INFORMATION.

  11. Copyright Infringement. Our policy responds to DMCA-compliant infringement notices. Infringing materials on Services can be identified and removed via our process. You agree to comply with this process if involved in copyright claims.

    If you believe your copyrighted work is infringed, provide our copyright agent with written information as specified below. This process is solely for copyright infringement notification. We do not make legal decisions on infringement validity or defenses. Upon valid notice, we will remove/block access to infringing content. We may request more information from the notice provider. Under DMCA, we must notify the alleged infringer, who can send a counter-notification. Notices/counter-notices are legal notices, distinct from regular Service communications, and may be published/shared at our discretion. False notices/counter-notices may result in DMCA damages, including costs and attorneys’ fees. Consult an attorney if unsure about copyright infringement.

    Send DMCA notices via written letter by regular mail only. Non-compliant notices may be ignored.

    DMCA notice must:

    1. Identify infringed copyrighted work(s).
    2. Identify infringing content and provide location info on Service (screenshots recommended).
    3. Provide copyright owner contact info (name, address, phone, email).
    4. Provide alleged infringer contact info (email preferred), if available.
    5. Include statement: “I have good faith belief that use of material is unauthorized.”
    6. Include statement: “I swear, under penalty of perjury, that information is accurate and I am copyright owner or authorized agent.”
    7. Be signed.

  12. Reliance on Information Posted. Service information is for general information only. We do not warrant information accuracy, completeness, or usefulness. Reliance on information is at your own risk. We disclaim liability from reliance on Service materials by you or any visitor.

  13. Changes to the Services. Service content may be updated, but is not always complete or current. Material may be outdated, and we are not obligated to update it.

  14. Relay of Content. NEOGOV relays content including resumes, applications, messages, etc. You authorize NEOGOV to send this content on your behalf. We process, monitor, review, store, and analyze content for data analysis, security, quality control, Terms of Use enforcement, content moderation, and Service improvement. Content delivery may be delayed or fail due to technical malfunction, and NEOGOV may notify you. Service use implies acknowledgement of this activity for Service quality and provisioning.

  15. Linking to the Services and Social Media Features. You may link to our homepage fairly and legally without damaging our reputation or implying our association/endorsement without written consent. We may disable social media features and links anytime without notice.

  16. Additional Terms for Third-Party Services. Services may link to third-party services outside NEOGOV (PowerLine, PowerEngage, etc.) or integrated with NEOGOV Services (background checks, skill assessors). NEOGOV does not perform or employ individuals for these services and does not supervise, direct, control, or monitor third parties.

    1. Links and Third-Party Content on Services. Links to third-party sites/resources are for convenience only. We have no control over these and accept no responsibility for them or resulting loss/damage. We do not control these services or their content/malware risks. Dealings with third parties on Services are solely between you and them. We disclaim responsibility/liability for third-party materials, programs, products, and services on Services, and are not responsible for losses/damages from such dealings or third-party presence on Services. Accessing third-party websites linked to Services is at your own risk, subject to their terms of use. Read all third-party service terms and conditions.
    2. Specific Third-Party Providers. Background Checks: Some Services let users use third-party background check services for applications. If you use background check services, you authorize NEOGOV to obtain your background check report and share it with Customers you apply to, and agree to background check companies’ terms of use. If using background checks on behalf of a Customer, you agree to lawful use and background check companies’ terms of use.
  17. NEGOV is not an employer. NEOGOV does not control employer HR practices or employment decisions made using Services. Employers are solely responsible for their Service postings. NEOGOV is not an employer regarding your Service use and is not responsible for employment decisions made by entities posting jobs on Services. Employers are responsible for privacy, collection, use, retention, and processing of employer data, and providing notices as legally required.

  18. NEOGOV is not a healthcare provider. NEOGOV may offer healthcare services through Services but is not a healthcare provider. NEOGOV facilitates access to telehealth, expert medical services, and emergency medical services, and is independent of healthcare providers and not responsible for their actions/omissions or communications. NEOGOV does not practice medicine.

    Services do not provide medical advice or create healthcare provider/patient relationships. Service content is for information only, not healthcare provider advice. Consult your healthcare provider for medical questions. Call 911 or your healthcare provider for emergencies. NEOGOV IS NOT RESPONSIBLE OR LIABLE FOR ADVICE, TREATMENT, DIAGNOSIS, OR INFORMATION OBTAINED THROUGH SERVICES.

  19. NEOGOV’s Disclaimers. We do not warrant that downloaded files from Services will be virus-free. You are responsible for anti-virus measures and data accuracy and maintaining external data recovery means.

    NEOGOV IS NOT LIABLE FOR DAMAGES/COSTS DUE TO SERVICE DELIVERY DELAYS/INABILITY CAUSED BY EVENTS BEYOND REASONABLE CONTROL (ACTS OF GOD, LAW CHANGES, LABOR PROBLEMS, TRANSPORTATION DELAYS, SUPPLY UNAVAILABILITY, FIRE/EXPLOSION, RIOT, MILITARY ACTION, GOVERNMENT ACTIONS).

    NEOGOV DOES NOT CONTROL DATA FLOW TO/FROM SERVICES AND THE INTERNET, WHICH DEPENDS ON THIRD-PARTY INTERNET SERVICES. THIRD-PARTY ACTIONS MAY IMPAIR/DISRUPT INTERNET CONNECTIONS. NEOGOV WILL MAKE REASONABLE EFFORTS TO REMEDY/AVOID SUCH EVENTS BUT CANNOT GUARANTEE THEY WILL NOT OCCUR AND DISCLAIMS RESULTING LIABILITY.

    SERVICE USE, CONTENT, AND OBTAINED SERVICES/ITEMS ARE AT YOUR OWN RISK, PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES.     EXCEPT FOR DAMAGES FROM NEOGOV GROSS NEGLIGENCE/WILLFUL MISCONDUCT, NEOGOV TOTAL LIABILITY FOR ALL CLAIMS UNDER THIS AGREEMENT IS CAPPED AT ONE HUNDRED ($100.00) US DOLLARS.

    THIS DOES NOT AFFECT NON-EXCLUDABLE/NON-LIMITABLE LIABILITY UNDER LAW.

  21. Indemnification. To the extent permitted by law, you agree to indemnify and hold harmless NEOGOV, its affiliates, licensors, and service providers, and their personnel from claims, liabilities, damages, etc., arising from your Terms of Use violation or Service use, including User Contributions, unauthorized Service content use, or use of information from Services.

  22. General. Unless stated otherwise, Terms of Use, Privacy Policy, and incorporated documents are the sole agreement between you and NEOGOV regarding Services, superseding prior agreements. You cannot assign Terms of Use without NEOGOV written consent. Waivers must be written and executed by the enforcing party. Services and Terms of Use are governed by California law, without regard to conflict of law provisions. Legal actions must be in federal/state courts in Los Angeles County, California, though we may sue you in your residence country. You waive jurisdiction/venue objections. We may require arbitration of disputes under American Arbitration Association Rules, applying California law, at our discretion.

  23. Waiver and Severability. NEOGOV waiver of a Terms of Use term is not a further/continuing waiver or waiver of other terms. NEOGOV failure to assert a right is not a waiver of that right. If any Terms of Use provision is invalid, illegal, or unenforceable, it will be limited to the minimum extent necessary, and remaining provisions remain in effect.

  24. E-Signatures.

    1. E-Signature Provisioning & Consent. NEOGOV E-Forms and electronically signed services (E-Signatures) are for two parties (sending party/personnel or job seeker) to electronically sign documents. Using E-Signatures means you consent to electronic signatures and business transactions, and can access E-Signatures and signed documents electronically. Consent applies only to the specific document.
    2. Right to Opt-Out of E-Signatures. You can opt out of E-Signatures and sign manually by notifying the sending party and obtaining a non-electronic document copy. Do not use E-Signatures to sign or return documents if opting out. NEOGOV is not responsible for providing non-electronic document versions.
    3. Electronic Download. After electronically signing and returning a document, you can download/print a paper copy for free. Notify the sending party and stop using E-Signatures if you withdraw consent, but prior e-signatures remain legally valid.
    4. E-Signature Validity. NEOGOV STATEMENTS ON ELECTRONIC DOCUMENT/SIGNATURE VALIDITY ARE FOR INFORMATION ONLY, NOT LEGAL ADVICE. ELECTRONIC SIGNATURES MAY NOT BE ENFORCEABLE FOR CERTAIN AGREEMENT TYPES UNDER LAW. NEOGOV DISCLAIMS RESPONSIBILITY FOR ENSURING E-SIGNATURE DOCUMENT VALIDITY/ENFORCEABILITY UNDER US OR ANY JURISDICTION’S LAWS. CONSULT LEGAL COUNSEL ON DOCUMENT VALIDITY.
